Do I Need Permission to Install CCTV?

Installing CCTV is a great way to deter crime at your home or business. But many people worry that they need permission before doing so. In this post, we’ll provide all the information you need to make sure you’re proceeding lawfully.

CCTV permission in brief

The short answer is no. You don’t need permission to install CCTV unless it is for a listed property or you are renting. In these cases, would need to ensure that you contact the Department of Planning or your landlord, respectively, before going ahead with installation.

This doesn’t mean that there are no guidelines to follow for everyone else. If your property has CCTV, you are responsible for making sure you are aware of data protection laws and the appropriateness of your cameras.

Residential CCTV

If you’re planning on installing residential cameras, the most important thing is where your camera covers. People can complain (and rightly so) if they feel that your cameras impinge on their privacy, so it’s best to get neighbours’ approval before installing cameras and position them considerately.

Another issue is recording public areas like the street. Again, people may not like being filmed going about their day-to-day business. On top of that, individuals who have been recorded can technically request any footage of themselves and you’re legally obliged to provide it.

Commercial CCTV

CCTV is fast becoming an extremely effective method of security for UK businesses. And although you may not need planning permission to install CCTV commercially, there are still a few things you’re expected to do:

  • Tell people they may be recorded (for example, using clear signs)
  • Use the system solely for what it is needed for – so no spying on staff
  • Control who can see the recordings

Remember that anyone can ask to see the recordings you have of them. This must be provided free of charge within a month. CCTV footage needs to be dealt with sensitively and with the knowledge of staff and visitors to your site. Some tips for ensuring you are on the right track include:

  • Think through how you’ll respect people’s privacy and rights
  • Consider if audio is necessary and how that affects permissions
  • Create a clear document that explains your reasoning for installing CCTV
  • Keep on top of the footage you record by reviewing and deleting regularly
